Important: B3EG Comment-Linked Proposals is a demo, research, and information-navigation website. It is not legal, regulatory, financial, investment, compliance, policy, lobbying, accounting, tax, or other professional advice. Do not rely on this site, its links, its margin tabs, its comment mappings, its AI-generated summaries, or any downloaded or embedded material as complete, current, accurate, authoritative, or suitable for any decision.
The site can be wrong. It may omit comments, include duplicates, misidentify commenters, link a comment to the wrong topic, fail to link a relevant comment, summarize a comment incorrectly, overstate or understate a commenter's position, include stale data, miss later-filed materials, fail to reflect later agency corrections, or misrepresent a comment because of source-data limits, download errors, parsing errors, PDF conversion errors, OCR errors, AI errors, model limitations, software bugs, or human error.
Official sources control. You are solely responsible for checking the Federal Register, govinfo.gov, the Federal Reserve, Regulations.gov, agency dockets, and the original source PDFs or records before relying on, citing, sharing, or acting on anything.
1. Acceptance of These Terms
These Terms of Service ("Terms") govern access to and use of the B3EG Comment-Linked Proposals website, pages, reports, links, embedded documents, generated margin tabs, AI-generated summaries, downloaded or locally hosted source copies, files, data, visualizations, and related materials provided by Bankview, LLC ("Bankview," "we," "us," or "our"). The website and related materials are referred to as the "Site."
By selecting "I Agree," accessing the Site after the Terms are displayed, using the Site, opening a report, opening a linked document, or continuing to use any part of the Site, you agree to these Terms. If you do not agree, do not select "I Agree" and do not access or use the Site.
If you access or use the Site on behalf of any company, organization, client, employer, trade association, government agency, law firm, consulting firm, financial institution, investment firm, academic institution, or other entity, you represent that you have authority to bind that entity. In that case, "you" includes both you individually and that entity, jointly and severally.
The Site is intended for business, professional, research, and demonstration use. It is not intended for children or for personal, family, or household consumer use. You must be at least 18 years old to use the Site.
2. Electronic Agreement, Records, and Retention
You agree to transact electronically with Bankview for purposes of these Terms. Your selection of "I Agree," your continued access to the Site after the Terms are displayed, and related browser or server records are electronic signatures, electronic records, and evidence of assent to these Terms to the fullest extent permitted by applicable federal law, including the Electronic Signatures in Global and National Commerce Act, applicable state electronic-transaction laws, and any similar law.
These Terms are available in a separate web page that you may open, print, save, or download. If your device, browser, assistive technology, or software cannot access, retain, print, or accurately reproduce these Terms, you must not use the Site. 3. What the Site Does
The Site is designed to help users navigate public comments related to three banking regulatory-capital proposals. It may display proposal text, public comment references, comment source links, local copies of public PDFs, AI-generated summaries, generated concept connections, margin markers, tables, charts, and related files.
The Site is a convenience layer over public and third-party source materials. It is not an official agency website, docket, record, comment database, legal research service, citation authority, or complete administrative record. Bankview is not affiliated with, sponsored by, endorsed by, or acting for the Board of Governors of the Federal Reserve System, the Office of the Comptroller of the Currency, the Federal Deposit Insurance Corporation, the Federal Register, govinfo.gov, Regulations.gov, or any commenter.
4. No Reliance and No Professional Advice
You acknowledge and agree that the Site and all Site output are provided only for demonstration, research, and information-navigation purposes. You must not rely on the Site for legal, regulatory, financial, investment, lending, capital-planning, compliance, policy, lobbying, business, academic, reporting, citation, litigation, rulemaking, or other decisions.
Bankview does not provide legal advice, regulatory advice, financial advice, investment advice, lobbying advice, accounting advice, tax advice, or any other professional service through the Site. Nothing on the Site creates an attorney-client, advisor-client, fiduciary, consulting, agency, partnership, or other professional relationship.
You are solely responsible for independent verification, professional review, source checking, docket checking, citation checking, and judgment. You must consult qualified professionals and official sources before making any decision or taking any action.
5. AI, Data, Linking, and Summary Limitations
The Site may use AI-generated or machine-assisted summaries, concept labels, comment-topic mappings, relevance determinations, question references, page references, file conversions, extracted text, and related outputs. These outputs are inherently limited and may be incomplete, inaccurate, outdated, biased, misleading, hallucinated, overinclusive, underinclusive, or wrong.
Specific risks include, without limitation:
- Relevant comments may be missing, hidden, withheld, later posted, later removed, or not downloaded.
- Comments may be duplicated, deduplicated incorrectly, grouped incorrectly, attributed to the wrong source record, or associated with the wrong commenter.
- Federal Reserve comment identifiers, Regulations.gov identifiers, docket numbers, source URLs, PDF links, page numbers, proposal sections, or local file paths may be wrong or stale.
- AI summaries may omit important qualifications, merge separate arguments, miss attachments, misunderstand context, misstate a commenter's position, or present a topic as more or less important than it is.
- Margin tabs and hover summaries may link comments to proposal sections too broadly, too narrowly, or incorrectly.
- Proposal text is intended to be reproduced from saved source material, but it may be altered, different from official source materials, incomplete, wrong, or not representative of the source proposal. Formatting, hidden sections, page markers, tables, footnotes, symbols, source extraction, conversion, browser rendering, or link generation may also introduce errors.
- PDF conversion, OCR, HTML conversion, browser rendering, file hosting, source downloads, and link generation may introduce errors.
- Source websites may change, remove, redact, supplement, correct, or reorganize records after the Site is generated.
Bankview has no duty to audit, correct, update, preserve, continue hosting, or notify you of any error, omission, stale content, changed source record, changed law, changed agency action, or later-filed comment.
6. Source Materials, Public Records, and Third-Party Content
The Site may display or link to government materials, public comments, third-party PDFs, commenter letters, attachments, Federal Register materials, Regulations.gov materials, Federal Reserve materials, govinfo.gov materials, and other third-party content. Bankview does not create, verify, endorse, approve, certify, or control third-party content.
Public availability of a document does not mean Bankview owns it, endorses it, has verified it, or grants you rights to reuse it. Third-party documents may contain copyright, trademark, confidentiality, privacy, attribution, defamation, or other issues. You are responsible for determining what rights, permissions, citations, notices, and restrictions apply before using, copying, redistributing, quoting, publishing, filing, or relying on any content.
7. User Responsibilities
You agree that you will:
- Use the Site only for lawful, non-misleading purposes.
- Verify all information against official sources and original documents.
- Not represent that Bankview, the Site, or any AI output is an official, complete, authoritative, or reliable source.
- Not use the Site as a substitute for professional advice, source review, docket review, or legal research.
- Not scrape, crawl, overload, attack, disrupt, reverse engineer, decompile, bypass access controls, or extract non-public materials from the Site.
- Not use the Site to train, fine-tune, benchmark, or evaluate AI systems without Bankview's prior written consent.
- Not use Site output in a way that is false, misleading, defamatory, infringing, unlawful, or likely to cause harm.
8. No Confidential or Sensitive Information
The Site is static and does not invite uploads or account registration. Do not send Bankview confidential, sensitive, regulated, personal, privileged, proprietary, or non-public information unless Bankview has separately agreed in writing to receive it. If you email Bankview, you are responsible for the content of your message and for ensuring that you have authority to send it.
9. Browser Storage, Cookies, Logs, and Similar Technologies
The Site may use essential browser storage, including sessionStorage or similar technologies, to remember that you accepted these Terms during a browser session and to support Site functionality. This is not intended as advertising tracking.
When you select "I Agree," the Site may request a static acceptance-log resource with the Terms version, acceptance time, and page path in the request URL so ordinary server logs can help document that the Terms were presented and accepted. Server logs may also record technical information such as IP address, user agent, referrer, request time, and response status.
The Site may also request a static page-view resource with page path, page title, and view time in the request URL so Bankview can count page views from private server logs. The Site does not display public page-view counts.
Bankview's hosting environment, reverse proxy, CDN, security tools, or server software may collect ordinary technical logs, such as IP address, request path, referrer, user agent, date and time, error information, and similar data. Those logs may be used to operate, secure, troubleshoot, improve, deploy, document, or defend the Site.
The Site may link to third-party websites. Those third parties may use cookies, analytics, tracking, logs, account systems, or other technologies governed by their own terms and privacy practices. Bankview is not responsible for third-party sites.
If you block or delete cookies, browser storage, scripts, iframes, or similar technologies, the Site may not work properly and the Terms may be shown again. If you do not agree to essential browser storage and ordinary technical logging, do not use the Site.
10. Ownership and Limited License
Bankview owns or controls the Site's selection, arrangement, interface, generated annotations, generated summaries, generated concept mappings, code, styling, workflows, report structure, and other Bankview-created materials, except for third-party and government materials. Subject to these Terms, Bankview grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and view the Site for internal research, evaluation, and demonstration purposes.
No rights are granted in third-party materials except whatever rights you independently have from the applicable owner or law. You must not remove notices, misattribute content, imply endorsement, resell the Site, create a competing service from the Site, or commercially exploit the Site without Bankview's prior written consent.
11. Availability, Updates, and Changes
Bankview may modify, update, regenerate, replace, suspend, disable, restrict, move, or discontinue the Site or any feature at any time, with or without notice. The Site may become unavailable, corrupted, partially deployed, stale, or inconsistent across files. Bankview does not promise any update schedule, uptime, maintenance, archival access, backwards compatibility, or continued availability.
Bankview may update these Terms at any time. Continued use after updated Terms are posted or displayed constitutes acceptance of the updated Terms.
12. Disclaimers
To the fullest extent permitted by law, the Site and all materials are provided "as is," "as available," and "with all faults." Bankview disclaims all warranties, conditions, representations, guarantees, and duties, whether express, implied, statutory, equitable, or otherwise, including warranties of accuracy, completeness, timeliness, reliability, title, non-infringement, merchantability, fitness for a particular purpose, quiet enjoyment, uninterrupted operation, error-free operation, security, compatibility, data integrity, and suitability for any legal, regulatory, financial, professional, compliance, citation, rulemaking, or decision-making purpose.
Bankview does not warrant that the Site will identify all comments, correctly summarize comments, correctly link comments to proposal sections, reflect all source records, preserve all links, reproduce all source material, remain current, remain available, or be free from AI errors, software errors, security issues, data loss, broken links, malicious third-party content, or other problems.
13. Limitation of Liability
To the fullest extent permitted by law, Bankview will not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, enhanced, statutory, equitable, or other damages; lost profits; lost revenue; lost opportunity; lost data; business interruption; reputational harm; reliance damages; replacement costs; professional fees; regulatory consequences; filing consequences; missed comments; missed deadlines; incorrect citations; inaccurate summaries; third-party claims; or any other loss arising out of or related to the Site, source materials, third-party content, AI output, links, downloads, omissions, errors, stale information, inability to access the Site, or these Terms.
This limitation applies regardless of legal theory, including contract, tort, negligence, gross negligence to the extent permitted by law, strict liability, product liability, warranty, misrepresentation, unfair or deceptive trade practice, consumer protection, privacy, data security, intellectual property, statutory claim, equitable claim, or any other theory, even if Bankview has been advised of the possibility of damages and even if a remedy fails of its essential purpose.
To the fullest extent permitted by law, Bankview's total aggregate liability for all claims arising out of or related to the Site or these Terms will not exceed the greater of (a) the amount you paid Bankview specifically to access the Site during the six months before the event giving rise to the claim, or (b) one hundred dollars ($100). If applicable law does not allow a limitation stated in these Terms, liability is limited to the maximum extent permitted by law.
14. Indemnification, Hold Harmless, and Duty to Defend
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Bankview and its affiliates, owners, members, managers, officers, directors, employees, contractors, agents, representatives, licensors, service providers, successors, and assigns from and against any and all claims, demands, actions, suits, arbitrations, investigations, subpoenas, liabilities, damages, losses, judgments, settlements, penalties, fines, costs, and expenses, including attorneys' fees, expert fees, court costs, arbitration costs, investigation costs, appeal costs, enforcement costs, collection costs, and defense costs, arising out of or related to:
- Your access to or use of the Site.
- Your reliance on, interpretation of, publication of, filing of, citation to, redistribution of, or use of any Site output, AI summary, link, concept mapping, margin marker, source copy, or third-party material.
- Your failure to verify information against official sources or qualified professionals.
- Your violation of these Terms, law, regulation, third-party rights, privacy rights, intellectual property rights, confidentiality duties, professional duties, or ethical duties.
- Any allegation that the Site omitted, misrepresented, misstated, mislinked, incorrectly summarized, or failed to update any proposal, comment, attachment, source record, agency document, or other information.
- Any dispute involving your organization, employer, client, user, device, browser session, downstream recipient, filing, publication, analysis, report, communication, or decision connected to the Site.
Your duty to defend applies immediately upon assertion, threat, notice, demand, filing, service, investigation, subpoena, or commencement of any claim or proceeding. Bankview may select counsel, control the defense, control strategy, participate in the defense, settle claims, and approve or reject any proposed settlement. You must not settle any claim in a manner that admits fault by Bankview, imposes obligations on Bankview, restricts Bankview's business, or fails to provide Bankview a full release without Bankview's prior written consent.
You must cooperate fully with Bankview's defense and must reimburse covered costs on demand. These defense and indemnity obligations are independent contractual obligations and apply even if a claim alleges that Bankview, the Site, software, AI, source processing, or a third-party provider caused or contributed to the alleged issue, to the fullest extent permitted by law.
15. Release, Covenant Not to Sue, and User-Initiated Claim Costs
To the fullest extent permitted by law, you release Bankview from all claims, demands, causes of action, liabilities, damages, losses, costs, and expenses arising out of or related to the Site, source materials, third-party content, AI output, links, downloads, errors, omissions, stale information, unavailability, or these Terms, whether known or unknown, suspected or unsuspected, fixed or contingent, direct or indirect.
To the fullest extent permitted by law, you covenant not to sue, file, threaten, maintain, fund, support, assign, transfer, encourage, or participate in any claim, lawsuit, arbitration, administrative proceeding, regulatory complaint, demand, investigation, appeal, or other proceeding against Bankview arising out of or related to the Site or these Terms.
If you, anyone acting for you, anyone acting through you, anyone acting on your behalf, any person using your device or organization, or any assignee or successor of yours brings, files, threatens, maintains, funds, supports, participates in, or causes any claim or proceeding against Bankview relating in any way to the Site or these Terms, you agree to pay and reimburse Bankview for all attorneys' fees, expert fees, investigation costs, court costs, arbitration costs, administrative costs, settlement amounts, judgments, appeal costs, enforcement costs, collection costs, and other legal fees, defense costs, and expenses incurred by Bankview, to the fullest extent permitted by law.
16. Federal Arbitration Act, Individual Arbitration, Class Waiver, and Jury Waiver
To the fullest extent permitted by law, and except for claims that Bankview elects to bring in court for injunctive relief, intellectual property protection, unauthorized access, security abuse, enforcement of indemnity or defense obligations, or collection of amounts owed, any dispute, claim, or controversy arising out of or related to the Site or these Terms must be resolved only by final and binding individual arbitration. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.
Arbitration will be conducted by a single arbitrator in North Carolina, unless Bankview agrees otherwise in writing. The arbitrator may award only relief that would be available to the individual party in court and may not conduct class, collective, consolidated, representative, private-attorney-general, or mass proceedings. Judgment on the award may be entered in any court with jurisdiction.
You and Bankview waive the right to a jury trial to the fullest extent permitted by law. You and Bankview also waive the right to bring or participate in any class, collective, consolidated, representative, private-attorney-general, or mass action or arbitration. Any claim must be brought only in an individual capacity.
17. Time Limit for Claims
To the fullest extent permitted by law, any claim arising out of or related to the Site or these Terms must be filed within one year after the claim arose. Claims not filed within that period are permanently barred. This contractual limitations period does not extend any shorter period that may apply by law.
18. Governing Law, Federal Law, Delaware Law, and Venue
These Terms and the Site are governed by the laws of the State of North Carolina and applicable federal law, without regard to conflict-of-law rules, except where federal law preempts state law or where Delaware law governs Bankview's internal affairs, entity powers, member, manager, owner, officer, indemnification, hold-harmless, limited-liability, or organizational matters.
To the extent Delaware law is relevant because Bankview or an affiliated entity is organized under Delaware law, Delaware law governs only those internal-affairs, entity, organizational, and indemnification issues that Delaware law requires or permits to be governed by Delaware law. Nothing in these Terms waives Bankview's rights under Delaware law, including any right of a Delaware limited liability company to indemnify and hold harmless covered persons to the maximum extent permitted by its governing documents and applicable law.
For any non-arbitrable claim or any court proceeding permitted by these Terms, exclusive venue and personal jurisdiction will be in the state or federal courts located in North Carolina, unless Bankview elects another forum for injunctive relief, enforcement, collection, intellectual property protection, unauthorized access, or internal-affairs matters. You consent to personal jurisdiction and venue in those courts and waive objections based on inconvenient forum or lack of personal jurisdiction.
19. Third-Party Services and Links
The Site may depend on browsers, operating systems, PDF viewers, hosting providers, reverse proxies, CDNs, government websites, third-party websites, public-record systems, and other third-party services. Bankview is not responsible for third-party services, third-party terms, third-party privacy practices, broken links, changed source pages, malware, downtime, redactions, missing records, access restrictions, rate limits, or other third-party acts or omissions.
20. Export, Sanctions, and Legal Compliance
You must comply with all applicable laws, regulations, sanctions, export controls, court orders, and government requirements. You must not use the Site if you are prohibited from doing so by applicable law or if your use would expose Bankview to legal, regulatory, sanctions, export-control, security, or reputational risk.
21. Assignment
You may not assign, delegate, or transfer these Terms or any rights or obligations under them without Bankview's prior written consent. Bankview may assign, transfer, delegate, or subcontract its rights and obligations in connection with a merger, sale, restructuring, transfer of assets, affiliate transfer, hosting change, corporate transaction, or by operation of law.
22. Severability, Reformation, and No Waiver
If any provision of these Terms is held invalid, unlawful, unconscionable, or unenforceable, that provision will be modified, narrowed, blue-penciled, or reformed to the minimum extent necessary to make it enforceable while preserving its intended protective effect to the maximum extent permitted by law. If it cannot be reformed, it will be severed, and the remaining provisions will remain in full force and effect.
Bankview's failure to enforce any provision is not a waiver of any right. Any waiver must be in writing and signed by Bankview. Section headings are for convenience only and do not limit the meaning of these Terms.
23. Entire Agreement and Survival
These Terms are the entire agreement between you and Bankview regarding the Site and supersede all prior or contemporaneous understandings regarding the Site. The provisions relating to no reliance, no professional advice, disclaimers, limitation of liability, indemnification, hold harmless obligations, duty to defend, release, covenant not to sue, arbitration, class waiver, jury waiver, user-initiated claim costs, ownership, governing law, venue, severability, and survival will survive termination, discontinued use, suspension, deletion, migration, expiration, and any alleged invalidity of another provision.
